1. Acceptance of terms

By downloading or using FitPilot ("the app"), you agree to these terms. If you do not agree, do not use the app.

2. Eligibility

You must be at least [Minimum Age] years old to use the app. If you are under the age of majority where you live, you may use it only with the consent of a parent or guardian.

3. Accounts

The app requires no account and no registration. You are responsible for the security of the device the app runs on, since that is where your data lives.

4. Using the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in line with the Apple App Store Terms of Service. You agree not to reverse engineer, resell, or attempt to extract the app's source beyond what applicable law permits.

5. Fitness and health disclaimer

FitPilot is a fitness and wellness tool. It does not provide medical advice, diagnosis or treatment, and it is not a medical device. Workout plans, suggested weights and any figures shown are general information, generated from the answers you give and the data on your device.

Consult a qualified healthcare professional before beginning any exercise programme, particularly if you have an existing medical condition, are pregnant, are recovering from injury, or are taking medication. Stop exercising and seek medical attention if you feel unwell. You exercise at your own risk.

Suggested starting weights are conservative estimates, not prescriptions. Judge every load against your own capability, and adjust it.

6. Apple Health integration

The app can integrate with Apple Health where you grant permission. That integration is optional, can be revoked at any time in Apple's Health app, and is described in full on the Health Data page. Health data displayed in the app is provided by Apple Health and the devices that wrote it; we do not verify its accuracy, and energy figures the app writes for a workout are estimates.

Apple is not a party to these terms and is not responsible for the app.

7. Your responsibilities

  • Give accurate information during setup — the plan is generated from it
  • Keep your device secure and backed up; your data exists only there
  • Use the app lawfully and for its intended purpose

8. Intellectual property

The app, its design, its exercise library and its branding are owned by Sumesphere and protected by intellectual property law. The data you create with the app is yours.

9. Third-party services

The app is distributed through the Apple App Store and integrates with Apple HealthKit. Your use of those services is governed by Apple's terms. Apple, Apple Health, HealthKit and iPhone are trademarks of Apple Inc. FitPilot is not affiliated with, endorsed by or sponsored by Apple Inc.

10. Purchases and subscriptions

[If the app is free with no purchases, state that here. If subscriptions or in-app purchases exist, describe pricing, renewal, cancellation and refunds, which are handled by Apple.]

11. Termination

You may stop using the app at any time by deleting it. We may discontinue the app or any feature, with notice where reasonably practicable.

12. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law, including fitness for a particular purpose and uninterrupted or error-free operation.

13. Limitation of liability

To the fullest extent permitted by law, Sumesphere is not liable for indirect, incidental, special or consequential damages, or for loss of data, arising from your use of the app. [Insert any liability cap agreed with your lawyer.] Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence.

14. Changes to the service

We may update the app and these terms. Continued use after an update means you accept the revised terms; material changes will be surfaced in the app.
